1. DEPOSIT TERMS
1.1 Deposit Amount: Buyer shall pay a non‑refundable deposit equal to 17% of the total purchase price or $340, whichever is greater.
1.2 Application of Deposit: Upon Seller’s receipt, the deposit will be applied toward the final purchase price of the selected puppy.
1.3 Deposit Payment Deadline: The deposit must be paid in full at the time of contract signing. Failure to pay by the deadline will result in cancellation of the Buyer’s reservation and return of the puppy to active sale.
1.4 Forfeiture Conditions: The deposit shall be forfeited in full if Buyer:
1.41 Withdraws the application
1.42 Fails to complete payment as agreed;
1.43 Provides false or misleading information on the application.
2. PUPPY SELECTION AND HOLD
2.1 Reservation Hold: Payment of the deposit reserves the specific Selected Puppy for the Buyer until the agreed pickup date.
2.2 Selection Confirmation: Seller will confirm puppy selection in writing (email or text). Buyer must respond within 48 hours to confirm continued interest.
2.3 Change of Selection: If Buyer requests a different puppy:
2.31 Seller may approve or deny the request at sole discretion.
2.32 Any price difference between the original and new puppy must be settled by Buyer prior to pickup.
2.4 Hold Extension Requests: Buyer may request an extension of the hold period. Extensions are granted at Seller’s discretion and may incur additional boarding fees as outlined in Section 3.
3. PICKUP, BOARDING, AND EXTENDED HOLDS
3.1 Pickup Deadline: Buyer must collect the puppy by the agreed pickup date.
3.2 Late Pickup Fees: If the puppy is not collected on time, Buyer agrees to pay a boarding fee of $50 per week, prorated daily.
3.3 Re-listing Procedure: Should Buyer fail to collect the puppy within seven (7) days after the pickup deadline:
3.31 The puppy will be returned to active sale.
3.32 Buyer forfeits all deposits and any boarding fees paid.
3.4 Vaccination and Care During Extension:
3.41 Any routine vaccinations or health checks falling due during an extended hold must be arranged and paid for by Buyer prior to pickup.
3.42 Buyer is responsible for covering all veterinary costs incurred during the hold extension.
4. FINAL PAYMENT AND PAYMENT PLANS
4.1 Final Balance Payment: The remaining balance is due at or before the puppy pickup.
4.2 Payment Methods: Seller accepts cash, credit/debit cards, and approved BNPL options (see separate BNPL Agreement).
4.3 Installment Agreements:
4.31 Buyers wishing to pay via installment must complete a separate installment agreement before pickup.
4.32 All installment terms, including schedule and amounts, must be documented in writing and signed by both
parties.
4.4 Ownership Transfer:
4.41 The puppy remains the property of Hart’s Precious Pups LLC until full payment is received.
4.42 Transfer of ownership and delivery of registration papers (if applicable) will occur only after full payment.
5. RIGHT TO REFUSE OR CANCEL SALE
5.1 Seller Discretion: Seller reserves the right to refuse or cancel any sale at any time if Buyer is deemed unsuitable, if funding fails, or if any contract condition is breached.
5.2 Notice of Cancellation: Seller will notify Buyer in writing of any cancellation. Deposits in this event will be refunded only if cancellation is initiated by Seller and no breach by Buyer has occurred.
6. BUYER AND SELLER OBLIGATIONS
6.1 Buyer Obligations:
6.11 Provide accurate contact and payment information.
6.12 Communicate promptly regarding pickup arrangements or hold extensions.
6.13 Comply with all care instructions provided by Seller prior to pickup.
6.2 Seller Obligations:
6.21 Ensure the puppy is healthy, vaccinated, and properly socialized at time of deposit.
6.22 Provide Buyer with all relevant health records, vaccination history, and care instructions.
6.23 Communicate any changes to pickup dates or puppy availability in a timely manner.
7. GENERAL PROVISIONS
7.1 Governing Law: This Agreement is governed by the laws of North Carolina.
7.2 Entire Agreement: This document constitutes the entire agreement between the parties concerning the deposit and sale.
7.3 Amendments: Any modifications must be in writing and signed by both parties.
7.4 Severability: If any provision is invalid, the remainder remains effective.
7.5 Notices: All notices must be sent to Buyer’s and Seller’s addresses provided herein, via certified mail or email.

HPP In House Financing- Subjected to Availability
1. DEFINITIONS
1.1 Seller: Hart’s Precious Pups (doing business as Hart’s Precious Pups under Hart Signature Group LLC), a North Carolina LLC with principal place of business in Fayetteville, NC.
1.2 Client: __________________________________ (“Client”), with billing address at ____________________________________.
1.3 Purpose: This Agreement sets forth the terms for the Client’s installment payments to purchase the Dog described under the Transport Services Agreement dated _____________.
1.4 Client Eligibility & Documentation: As a condition for in-home financing, Client must provide any requested legal documentation and, if required by Seller, successfully complete a county-level criminal background check at Client’s expense prior to disbursement of the first installment. Failure to satisfy these requirements may result in financing denial and cancellation of this Agreement.
2. APPLICATION AND APPROVAL
2.1 Eligibility: Buyer must meet the BNPL Provider’s credit and eligibility requirements.
2.2 Authorization: By selecting a BNPL option at checkout, Buyer authorizes Seller to share necessary order and personal information with the BNPL Provider for credit evaluation and installment plan setup.
2.3 Approval: Financing is subject to separate approval by the chosen BNPL Provider. Seller has no obligation to refund any initial payment if financing is declined after order placement.
3. PAYMENT TERMS
3.1 Down Payment: Buyer agrees to pay any required Down Payment at the time of purchase.
Installments: Buyer shall make all subsequent installment payments directly to the BNPL Provider in accordance with the Payment Schedule.
3.2 Processing Fees & Interest: Any fees or interest charged by the BNPL Provider will be disclosed during checkout and are governed by the BNPL Provider’s loan agreement. Seller is not responsible for such fees or interest.
3.3 Taxes & Shipping: Applicable sales tax and shipping charges may be collected either by Seller or BNPL Provider, as indicated during checkout.
4. CANCELLATION, RETURNS, AND REFUNDS
4.1 Order Cancellation: Buyer may cancel the Products only in accordance with Seller’s cancellation policy and within any cancellation window offered by the BNPL Provider.
4.2 Returns & Exchanges: Buyer must follow Seller’s standard return/exchange policy.
4.3 Refund Processing: Upon Seller’s receipt and acceptance of a valid return, Seller will issue a refund to the BNPL Provider for all amounts paid by Buyer. The BNPL Provider will process the return of payments in accordance with their policies; Buyer understands that any interest or fees charged by the BNPL Provider may not be refundable.
4.4 BNPL Adjustment: The BNPL Provider will adjust Buyer’s installment plan to reflect the refunded amount. Buyer remains responsible for any outstanding balance, fees, or interest.
4.5 Non-Refundable Fees: Any non-refundable fees imposed by the BNPL Provider (e.g., origination fees) will not be reimbursed by Seller.
5. DEFAULT AND REMEDIES
5.1 BNPL Provider Defaults: If Buyer fails to make timely payments to the BNPL Provider, the BNPL Provider may charge Late Fees, report delinquency to credit bureaus, or pursue collection actions.
5.2 Seller Remedies: If the BNPL Provider does not remit payment to Seller (e.g., financing cancellation), Seller reserves the right to:
5.21 Revoke transfer or request return of the puppy at Buyer’s expense.
5.22 Cancel Buyer’s purchase agreement and relist the puppy for sale.
5.23 Pursue collection of unpaid Purchase Price plus any associated costs.
5.3 Reinstatement: Buyer may reinstate any canceled order by resolving financing issues directly with the BNPL Provider and notifying Seller in writing within five (5) business days.
6. BUYER REPRESENTATIONS AND WARRANTIES
6.1 Buyer represents and warrants that:
6.11 The information provided during checkout is accurate and complete.
6.12 Buyer will maintain sufficient funds or credit availability to cover all installment payments.
6.13 Buyer understands and agrees to all terms of the BNPL Provider’s financing agreement.
7. LIMITATION OF LIABILITY AND INDEMNITY
7.1 Seller Liability: Seller’s liability for any claim relating to BNPL financing is limited to the refund of the Purchase Price actually received by Seller.
7.2 Indemnification: Buyer agrees to indemnify and hold harmless Seller from any claims, liabilities, losses, or damages arising from Buyer’s breach of this Agreement or the BNPL Provider’s agreement.
8. PRIVACY AND DATA SHARING
8.1 Data Disclosure: Buyer authorizes Seller to share order and personal information with the chosen BNPL Provider for financing and fraud prevention.
8.2 Privacy Policies: Buyer’s privacy is governed by Seller’s Privacy Policy (available at www.hartspreciouspups.com/privacy) and the selected BNPL Provider’s privacy policy.
9. GENERAL PROVISIONS
9.2 Entire Agreement: This document constitutes the entire agreement between the parties concerning the deposit and sale.
9.3 Amendments: Any modifications must be in writing and signed by both parties.
9.4 Severability: If any provision is invalid, the remainder remains effective.
9.5 Notices: All notices must be sent to Buyer’s and Seller’s addresses provided herein, via certified mail or email.

1.4 Payment Schedule: The timetable of installment due dates as provided by the BNPL Provider.
1.5 Late Fee: A fee charged by either the BNPL Provider or Seller for any late or missed Buyer payment.
